Many people have considered trying to work with their lender have ended up discouraged, and mistreated. Lenders have not reached an understanding of what is causing payments to be late and lack expertise to resolve the problem.

At this point lenders know how to ask for a payment and threaten litigation and foreclosure.

Do you go to an accountant to do your taxes, go to a doctor when you are sick, or a repair shop when your car is not working properly? If the answer to these questions is yes; then you believe in hiring a professional who is well trained and knowledgeable in their field to assist you when in need. If the answer is no please read the story below so that you can be prepared for what is to come.

We purposely left out the Lender's name (Brand X Mortgage) as to not publicize their poor service. Our goal is to work with the lender so that we (borrower, lender, and loss Mitigation Company) are a cohesive team.

I am writing to you for your help assistance or any form of involvement to negotiate or transact with BRAND X MORTGAGE's Loss Mitigation department.... I am getting all kinds of misinformation from them and am afraid of losing my home because of their lack of consistency, ethics, incompetence or whatever it is... It seems they are stringing me along until I am faced with a foreclosure. I did some research on the web and found this to be the case in many instances with other homeowners.

Brief Summary:
My wife had some unexpected medical issues with her heart which caused us to fall behind on our mortgage due to increased medical expenses. I contacted BRAND X MORTGAGE in July 2008 and explained our circumstances and they explained that we could possible qualify for a
loan modification...

On July 31, 2008, I spoke with Angela and gave her all our financial information over the phone. She said that based on that we may qualify for a loan modification but it would still have to go for review with a negotiator. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On August 19, 2008, I spoke with Maura and being that I had not heard anything, she said that it was pending and there was no further information available and to keep calling back. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On Sept 2, 2008 received a voice message from Jeff Cunningham...

On Sept 4, 2008 returned the call and spoke with Susie and she told me that the expenses had to be reviewed and if there were any changes... I said no everything was the same.. She further informed me that this would be sent to Jeff Cunningham and to call back in a week to get the status of the loan modification. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On Sept 12, 2008 received another voice message from Jeff Cunningham

On Sept 16, 2008 returned the call and spoke with Bryson and he requested information on the taxes and insurance of the home. Again I gave them the monthly allocation for both... He said the call back in a couple of days for the status. I ASKED IF I SHOULD MAKE A PAYMENT, HE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

on Sept 19, 2008 I called to further inquire and spoke with Tameka, she again said it was in review and reviewed my financials again and asked about the taxes and insurance... Told her everything was the same. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION. She said to call back in a couple of
days.

On Sept 22, 2008 received a voice message from Jeff Cunningham

On Sept 24, 2008 returned the call and spoke to Jasmine. I also mentioned that I received a letter stating that the loan modification was denied. She informed that there was a deficiency that the expenses were greater than the income as per the credit report... I further reviewed the info with her and explained that I had cosigned for family on those particular loans but was not making nor financially responsible for the payments. She said she would remove them which gave us a positive cash flow of $550+ per month and forward the info to the negotiator Jeff Cunningham. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION. She said to call back in a few days to get the status.

On Oct 3, 2008 - I called to inquire on the status and spoke with Victoria she informed me that the modification was denied for a deficit.. I explained to her my previous conversation with Jasmine. She informs me that the information was not saved in the system. I again furnish her all the same info and she assures me that the info was saved and to callback on Saturday. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On Oct 4, 2008 Saturday, I spoke with Raenne, she again tells me that the info was not saved in the system and I again informed her of my conversation with Victoria and again informs me that the information was not saved again I give her all the info. She tells me that I qualify for a loan modification and need to make a payment of $1800 by Oct 14, 2008 but does not have the details of the terms. That I will receive them within 10 days.. I explain that I can't I accept something without getting full disclosures of the terms.. I told her that I would discuss it with my wife and get back to them on Monday which she informs me that the $1800 payment would be required 10 days from the date I accept these '***' terms which of course she does not have any details... I was completely perplexed because of my previous conversation Victoria assured me the the info was saved.

On Oct 7, 2008 I call again and speak with Victoria (same person as on Oct 3, 2008). She informs that what Raenne told me was all wrong that she must not have seen the our loan modification was reactivated and still in review. Furthermore she said that after our conversation on friday she checked the system and all the info was saved and negotiator was reviewing our file. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION. She further informs me to call back on friday that I should have a response/resolution on my loan modification by then.

On Oct 8, 2008 I receive a package from process server.. As I open the package I am dumb founded to see a demand notice from an Attorney notifying me that my home is in foreclosure... All this time while I was under the impression that they were supposedly working on a loan modification to save my home.... they were actually processing it for foreclosure.... Which further perpetuates the increasing expenses.

On 10/10/08 called BRAND X MORTGAGE to get status on my Loan Modification only to find out that NOTHING has been done. I received foreclosure notice yesterday as I mentioned previously. They just strung me along to process a FORECLOSURE.

Spoke with Steve, I asked if I could record the conversation and of course he disapproved. I asked to speak to supervisor and transferred me to the Loss Mitigation dept.

Sabrina got on the phone. Said she was a loan specialist, I answered what does that mean she answered someone that can help me. My response was that I thought that is what I was doing since July 2008 with all the other people I spoke with there. All she could answer was that she apologized and can only be accountable for her actions. Now she mentions that I need to fax all information to them because this is what the investor requires... I said granted but why did they not tell me this when I first spoke with them. She said she understood but can only answer for herself. I asked about the foreclosure and the additional fees. She responded that the fees would be part of the loan modification but if I got her the documentation she requested by Tuesday, it would hold of the foreclosure and to have at least two mortgage payments when loan was approved for modification. To call Back within 72 hours to confirm that the fax was received.

Once bitten twice shy.... What assurance do I have that this time they will do as they said... I am dealing with the same people mentioned in the reports I attached...Do I have I choice, no I have to continue on this endeavor and hope and pray that they will do as they say....

Someone has to get involved when Corporate America acts in this manner with its consumers.

This is fraudulent and deceptive business practice.... Stringing me along for the long haul to foreclosure.... All they had to say from the beginning is that I must make my payment and no loan modification will be done... I would have found a way to pay the month and a half I was behind not lead me to believe that they were working to help me restructure my loan...

PLEASE HELP -- I AM IN DIRE STRAITS -- AND I AM SURE OTHER FLORIDIANS ARE IN SAME OR SIMULAR SITUATIONS --

If this is also the case with other lenders, this inflating bubble is going to burst in the worst possible way. Property values in Florida will not only decrease further but plummet. This will further cause unemployment to double digits, increase crime, poverty will be similar to those from the great depression. No jobs no money, no money no consumption, no consumption no jobs, ..... get the picture... Domino affect.... Downward spiral.... Where is this $700 billion bailout coming from.... taxpayers??? But who bails them out!!! You cant get water from stone.... If taxpayers are not working no taxes and if no taxes no money for bail out!!!!.... Again where is it coming from???

Since I received a Foreclosure Notice, I must respond which I will and am also including this email and all the reports I found on the web and am recording it the courts so if and when the time comes before the Judge he can see it too!!!
